  • The purpose of this study is to examine the U.S. Coast Guard's origins and powers with respect to the warrantless searches of vessels at sea. In principle, searches and seizures of vessels at sea require a warrant. However, a ship at sea may easily slip away and destroy evidence while authorities attempt to get a warrant. Thus, warrantless searches and safety inspection need to be validated because of the exigent circumstances at the sea. There are also two kinds of exceptions that justify warrantless searches at sea namely, border searhes and administrative searches. These theories in the U.S. will be useful for legislation and law enforcement related to the Korea Coast Guard's mission.

  • KCG, responsible Agency of maritime SAR operation has been known to address the marine casualties well, however, it was criticized because KCG failed to take prompt and effective response to the recent Ferry disaster at the very early stage. In this regards, the authors analyze the characteristics of marine incident with historical data, and also review and examine the national SAR system focusing on SAR coordination and human resources to make recommendation and suggestion in order to minimize the loss of lives to future marine incidents. As a result, KCG shall augment its capabilities, inter alia, fast libeboats and rescue helicopters for prompt response to marine incidents at the coastal waters, and KCG shall re-adjust the establishment of Rescue Coordination Center to improve operational problems of current system in accordance with IMO guidance, KCG is required to introduce mandatory training, qualification and certificate system to enhance the professionalism of SAR personnel.

  • 검찰과 경찰에서는 압수수색을 통해 조사를 수행하는데, 기업들은 압수수색 수사를 받기 전에 회계 DB 및 회계 관련 파일 삭제, 파손 및 은닉하는 등의 문제점을 발생시키고 있다. 2008년 삼성화재 비자금 조성 사건과, 2009년 교하 복합커뮤니티 센터의 입찰비리 사건 등 기업회계장부의 포렌식 기술적용방법 문제 등이 발생하고 있다. 본 논문에서는 포렌식 수사 도구인 EnCase, FinalData 등을 연구하고, 기업의 회계 서버에 대해 압수수색 준비와 압수 수색, 획득 증거 분석 등의 절차를 연구한다. 기업의 회계 서버 압수수색 후에 디스크에서 포렌식 증거분석에서 실시되는 증거물 원본 파일보관, 원본성이 입증된 사본생성, 삭제 파일 검사 및 복원, 삭제 내용 확인, 원본 파일과의 대조를 실험을 한다. 본 연구 결과는 포렌식 기술발전에 기여하게 될 것이다.

  • As the numbers cf vessels in and out cf korean ports and passing ships through korean waters are increasing, possibilities of marine accidents grow higher and damages caused by such accidents would be expected larger. The author accordingly try to seek for the appropriate measures to enhance the present korean Search and Rescue(SAR) systems and future plans comparing korean system with international movement and relevant systems of maritime advanced countries.

  • 충돌, 좌초, 화재 등 실질적인 해양사고는 조금씩 감소하고 있지만 기관고장, 타기고장 등 단순사고는 매년 증가하고 있으며, 우리나라는 구난업체의 영세성으로 대부분의 예인구난을 해경 경비정에서 수행하고 있으나 선박예인은 사고선박의 크기, 선박고장 또는 파손상태, 기상개황에 따라서 고도의 예인기술을 필요하고 예인 중 타선박과 충돌이나 좌초, 침몰 등이 발생할 확률이 높아, 사고시 이의 인한 인적, 물적, 환경적 피해에 대한 손해배상문제 등이 대두 될 수 있어, 예인구난에 대한 관련법령 및 제도를 재검토하여 해상 예인구난체제 개선방안을 제시하였다.

  • The Korea Maritime Police Agency(KMPA) is the national maritime Search and Rescuee (SAR) authority with the responsibility to promote an efficient organization of SAR services and to coordinate the conduct of SAR operations within the Korean Search and Rescue Region(SRR). The maritime SAR operations shall provide an adequate and effective search and rescue services to minimize the loss by rendering aid to persons in distress and property in the marine environment. The essence of a successful search and rescue operation is the speed with which it is planned and carried out because survivors who need assistance and whose chances of survival diminish rapidly with time. This paper aims to propose an optimal allocation model of maritime SAR fleet in view of minimizing the search and rescue time. When maritime accidents occur, rescue units have to reach to the distress scene within the specified time. For this, SAR units must be redeployed to an advanced base so that Rescue Units(RU) can reach to the scene of distress in the shortest possible time. The Korean maritime SRR is divided into 180 sub-areas in consideration of an operational and technical ability of SAR units. The suggested model is verified through an empirical application to the Korean maritime SRR. And also the Rescue Vessels(RV) required is estimated for each Rescue Co-ordination Center(RCC).
