Unconstitutionality of Call to Arms for Police Action (치안활동을 위한 군병력동원의 위헌여부에 관한 고찰)

  • As for the anti-terrorism bills, which were submitted to the National Assembly, the mobilization of anti-terrorism commando, which was designated or established by the National Defense Minister, is mobilized the military troops without being based on marital law in light of the constitutional law, thereby possibly violating the constitution, first of all, with regards to mobilization of anti-terrorism commando, which was formed with military troops. The anti-terrorism commando is the military force, which was trained professionally for the anti-terrorism activity. Thus, the violation of human rights may be greatly reduced rather than what general soldiers are putted in the public-order activity such as anti-terrorism. However, it is thought to be desirable to make it possible for the input of special forces, which were trained professionally in relation to anti-terrorism activity, through constitutionally revising the constitutional law. As for the provision of 'support for military troops' in the anti-terrorism bill, what is a case that the nation's important facilities and multi-use facilities are difficult to be protected from terror with the anti-terrorism commando and police force needs to be constitutionally regarded as resulting in reaching the level enough to correspond to 'a state of national emergency equivalent to wartime incident.' Thus, enacting the future anti-terrorism law, it is thought to be unnecessary for having the provision of 'support for military troops' with receiving criticism obstinately for possibly violating the constitution.

  • The aim of this study is to discuss some of the prominent ideas which use drone for police works. Focusing on the extent of the utility and practicability of using drone in policing, this paper attempts to address both positive and negative aspects in conjunction with related statutes and regulations. This study uses a qualitative case study approach and offers three practical implications including: (1) enacting a law that covers using drones in policing, (2) hiring technical professionals or training police officers to prevent illegal drones and to implement a variety of policing strategies, and (3) collecting data and information on crime and criminals and then developing the best way to respond to these problems.

  • In modern society, citizen's expectation about policing levels have been rising over time and it limited resources of the police to deal with the security services are insufficient. Until now, the state monopoly of the police activity was changing to subject of a variety in cooperation with public security system. The citizens considers community not the destination to police enforce the law but space for effective policing partners. Japanese police focus on cooperation oriented policing to strengthen the police and local residents with crime prevention for a long time. Also, the community through a variety of problem-solving policing activities to identify problems such as anxiety and anguish of the people. The legal basis for cooperative policing activity is that Nagaoka city crime prevention regulation in 1979. In recent years, Tokyo local government legislated the safe town development regulations(東京都安全 安心まちづくり條例) and set up the hot-spot area to promote the safety of public facilities. Cooperative policing not police intervention for crime prevention but national policy for the city reclamation in Japan. Police as well as the Ministry of Land and Transport, Ministry of Justice, Ministry of Education, Prime Minister and all government departments thread safe city, crime prevention, and has been working to make the safe city. Japan's cooperative policing is a system that receives the most attention and greater implications.

  • 경찰에게 요구되는 사회적 기대는 당시의 현실 사회가 처해진 상황에 따라 상이하다. 한국의 교통은 산업화와 더불어 급격하게 발전해왔다. 현재도 진행되고 있다. 그러나 이러한 전 국토적인 교통환경 변화를 긍정적으로만 이해할 수 없다. 예컨대, 기동성을 갖춘 '위험'을 양산하는 부작용을 파생했다는 측면 등도 부정할 수 없기 때문이다. 현 단계에서 경찰의 차량을 이용한 치안활동의 중요성을 인식할 필요가 비교적 분명하다고 할 수 있다. 본문에서는 경찰차량추격 활동의 정책지원을 모색하기 위한 당면과제로서 관련 통계수집을 위한 콘텐츠 개발을 검토했다.

A Comparative Study on Cognition Difference of Maritime Polices' Organization Culture (해양경찰공무원의 조직문화에 관한 인식차이 연구)

  • Maritime police recognize that the organizational culture of various acting as a member of the organization. Also, marine policing and security activities to determine the number of build. The overall culture of maritime police who share the organization sub-culture may take place. Maritime police organizational culture and a variety of types of group culture, hierarchical culture, development culture, rational culture examined the differences in perceptions. Maritime police aware of the general results of the analysis are as follows; First, the maritime police officers of the age group of 20 was the highest recognition in hierarchy culture and rational culture. Second, the maritime police officers of the rank of captain was the highest recognition in development culture and rational culture. Third, differences in the perception of organizational culture by recruitment analysis show the difference in cultural groups showed, in particular, the special recruitment group of police officers, and maritime police culture can be seen tend to appear low.

  • The government and the police are trying to expand the safety of the people by spreading "four major social evil erasures" intensively crackdown and prevention activities of sexual assault, school violence, domestic violence, and bad foods for the main purpose of security activities I made an effort. However, in spite of such efforts, the public's feelings of social unrest and the concern about security have not been significantly improved. Therefore, in this paper, using R which is the tool for analyzing big data which is most widely used in each field such as enterprise, consulting, public field, etc., R Using variables measured at each level, we analyzed by analyzing multiple regression analyzes, and confirmed what kind of correlation there is in relation to the direction affecting policy improvement I will try to present it.

  • The occurrence of complicating, multilateral social condition demands the strategy for facing many social state and consolidating public security against criminal loss. The lacking ability of local police for preventing crime can't satisfy the demand of security and can't get rid of fear of crime. At last, it brings a distrust of public confidence and became a factor of serious social crisis. We have problems - not only making an alternative plan for preventing crime, but also introducing CPTED(Crime Prevention Through Environmental Design) by environmental design, to expect crime prevention and to select systemic crime prevention system and the most suitable model. And we have a goal - to recognize the importance of guard activity for local crime, analyse public safety activity in community & focusing guard activity as a strategy for them, apply CPTED in police and private security company as a local crime prevention & setting effective model, and, make it as an index for preventing & dealing with intellectual, brutal crime. The rapid growth in the guarding-activity field lighten the burden of police for crime-prevention. But the misjudgement of some people blocks it to be settled institutionally. It needs to reconsider what is the effective crime-prevention method, at this point of time when the all parts of a nation changing into unlimited competitive, private self-control system.

A Study on the Hybrid Policing of Policing Space Follow Character Alteration of Space (공간의 성격변화에 따른 Hybrid Policing의 치안활동 영역에 관한 이론적 고찰)

  • When the character of space could be dichotomized into the existing public space and private space, social order could be maintained by public policing only, Since enormous private property was formed and private space was enlarged by the development of capitalism, however, the necessity of private policing system came to the front. The large capitalists began to establish separate policing system to protect their property and safety. However, as social alteration was further diversified scale of economy was enlarged, the character of space could not be simply explained owing to the formation of space that could not be explained by simple dichotomous division. Namely, the 3rd space was formed as middle class between public space and private space. The 3rd space created additional demand of policing besides the existing public policing and private policing. The policing system to safety such demand of policing is called hybrid policing. As policing system in which character and legal status of public policing and private policing are mixed, the hybrid policing system may be originated from the diversification of demand of policing. Johnston insists that the demand of hybrid policing system will be further increased, becoming the model of policing system in the future. In Korea, the police guard system or special guard system can be classified into the type of hybrid policing. In accordance with the trend of diversified demand of policing in the future, I suggest to develop Korean model of hybrid policing system so that it can be utilized in elevating the policing index in Korean society.

A Study on the Utilization of Private Security for Preventing School Violence (학교폭력 예방을 위한 민간경비의 활용방안)

  • School violence is now considered not only as a problem for a victim and a offender themselves, but also as a social problem that requires responsibilities of school, home, society, and even nation. Crimes and risk factors are various inside and outside of school. In terms of solving those problems, this study examines the actual condition of school violence among students. In addition, it is considered what efforts are conducted by police to establish a safe school environment and the problems that derive from it. Futhermore, this study aims to discuss the ways of using the private security with regard to dealing with school violence. In this society, the expectation of security service from the police is increased as time passed. However, police has limited resources, thus it is beyond their practice. Policing has changed from being monopolized by government to cooperating with various security agents. Community is not considered as the subject for enforcing the law anymore, but as the cooperator for effective policing. With regard to the limitation of police force, using the private security is an effective alternative. Therefore, it is required that private security should be assigned legal authority and shared information with schools in order to patrol the blind spot. Finally, school violence prevention efforts should be conducted by applying physical and electronic security.

  • 'SMART Police' means collecting, analyzing and utilizing the police database such as crime statistics, reflecting 'strategic management', 'analysis and research', 'science technology' do. In recent years, the number of sex offenses has more than doubled based on the 'crime analysis' of the Supreme Prosecutors' In this trend, we started to build a sex crime prevention program for women 's relief special 3.0 which is suitable for regional characteristics. However, it was not enough for the women to have low publicity and utilization results, and to show the practical effect. In the future, we propose a crime prevention system which can safely take home safeguarding with autonomous driving car or drone by applying ICT to the future police system. Although it is difficult to operate autonomous vehicles and drones in the surrounding environment such as narrow alleys and power lines for application to this system, it is thought that the artificial intelligence technology can be sufficiently overcome to operate.
