  • As Shapiro and Varian argue the open approach generates bandwagon effects and facilitates the diffusion of a standard thanks to network externalities. However, the open approach is not linked automatically to economic benefits as suggested by some famous cases as the IBM PC history. On the contrary, the closed approach enables a tight control over a technology and its development, and insures the appropriation of economic benefits. As Shapiro and Varian suggest, a firm can also decide to mix an open approach with tight control over improvement or extentions. Patent pool is to offer fair, reasonable, nondiscriminatory access under a single license to patents that are essential for the use of standards-based or other platform technologies. patent pool offers only one license to everyone, Since each patent is essential, the royalty rate and thus the value is the same whether a licensee uses one or more patents.

Quantitative Analysis of LTE Essential Patents (LTE 표준특허의 정량적 분석)

  • Patent information, which is generated under a specific, objective rule for a prolonged period of time, has the properties of technology, right, and management. Because of these characteristics of patents, patent analysis is used to identify R&D capacities and performances, and management strategies of a given nation or enterprise. In this paper, we analyze LTE essential patents which are key IPRs for implementing standardized LTE technology and major weapons in a global patent war. Total of 2,307 LTE essential patents, published and registered applications from European Telecommunications Standards Institute(ETSI)'s online IPR database as of January 2011, are analyzed in quantitative methods. The analysis results present status and statistics of LTE essential patents by major countries, applicant companies and technical fields. And a comparative study is done using 4 patent indices limited to the LTE essential patents issued in the United States. It is expected that results herein are useful for not only figuring out the technological competitiveness of countries and companies in LTE market, but also suggesting a guide to strategic IPR management for related industries.

  • It is well known that in the knowledge-based economy a firm's intellectual property including patent is crucial for its competitive advantage. In industrial economy, tangible assets such as land and equipment have been of critical importance for a firm's competitiveness. However, as the paradigm shift to the knowledge-base economy is being accelerated, intangible assets such as intellectual property are considered to be more influential for a firm to be competitive. The valuation of intangible asset is as necessary as that of tangible asset. In particular, reasonably accurate valuation of patent which represents a firm's technological competitiveness seems to be of great importance since (1) it is essential for a firm's patent strategy development, (2) it can activate the technology market, and (3) it is necessary to evaluate a patent's technological contribution when multiple patents are used to develop and commercialize an innovative product. Unlike that of tangible asset, the valuation of intangible asset is very difficult. In order to figure out a value of patent it is necessary to use a number of appropriate valuation factors. In this paper, we surveyed various valuation factors presented by previous researches and several technology valuation organizations to find a set of common valuation factors considered to be of more importance.

  • It is very essential issue in industrial advancement and company survival for international standard body to adopt standards including ICT that domestic company or our country owns. Also, advanced countries fiercely contest in order to include domestic technology in international standard and make every effort to secure essential patent relating to core and basic technology in international standard. In this circumstances, it is necessary to develop standardization strategies and take systematic approaches in an attempt to upgrade our country to strongly knowledge-based country in 21th century and achieve a leading position in ICT market. Therefore, this paper will suggest systematic and comprehensive approaches from planning of technology development to securing essential patent of international standard and have the purpose of making standardization base as well as promoting international standardization of domestic technology.

Also, we discuss the status of standard patent data, main applicants and standardization trends based on declared in ETSI standard patents. Especially, we analyzed 15,073 patents data which are possible to analyze patent information.

  • In light of the fact that the effect of intellectual property rights like patent on enterprise competitiveness is growing, rational valuation of patent rights, which are own by enterprises, is required because accurate patent valuation can bring about the activation of the technology exchange market and enhancing the values of enterprises as well as the security of funds through technology security. However, in reality, interest in the value of patent rights is not great due to many variables, affecting patent rights, and diverse attributes, and non-generalized methods of valuation. Therefore, studies on patent valuation for patent management of Small and Medium Enterprises is required. This thesis examined patent valuation for the patent management of Small and Medium Enterprises based on literature studies, and attempted to find factors, affecting patent valuation by finding patent valuation factors through experts, organizing, and analyzing these factors. 10 essential factors, which are demonstrated in this research, are the commercialization possibilities of technology, market competitiveness, the possibility of technology commercialization, market size, the originality of acquired technology, the stability of the right(the possibility of invalidating), the level of technology, technology competitiveness, the ripple effect of technology, and the characteristics of technology(original technology/application technology).

The impact on earnings patent technology transfer business performance of the Industry-Academic Cooperation Foundation (산학협력단의 특허실적이 기술이전사업 성과에 미치는 영향)

  • This study examines how the patent results of the University Academic-Industrial Cooperation influence technology transfer. Statistical analysis was performed by using 2013 panel data from the Ministry of Education and Science Technology(MEST) National Research Foundation of Korea(NRF) and the results are as follows. The results show that the patent result factors that have a positive effect on the total number of technology transfers are domestic patent application numbers, foreign patent application numbers, future technology(6T) patent application numbers, science technology patent application numbers. The factors that have a positive effect on increasing royalty are the total number of technology transfers. Domestic patent application numbers, future technology(6T) patent application numbers and science technology patent application numbers have a positive effect on patent results. The results implicate that more research and development is needed for more patents to be applied, that the main focus should be on future technology(6T) and science technology fields, and that effort should be directed at planning negotiation strategies for the term of the contract. However, this study is the need to research, including primary research is so patent performance may be limited in having only been considered in future studies of human and material resources and operating system factors that may be presented to the essential elements of the Industry-Academic Cooperation Foundation this raises.

  • Recently, a high speed spindle is an essential part of machine tools to satisfy latest demand of high precision product and machining of hard materials. But, there are many disadvantages such as heat generation of built-in-motor, bearing friction, noise, vibration and displacement because of the high speed. Many researches on spindle systems have been conducted for solving these problems. In this study, technical trend of machine tools spindle systems are analyzed with patent PSM, mapping and grouping. The analysis is carried out for the applied patent during January 2000 and December 2009 in Korea, Japan, EU and U.S.A. And development of the direction, strategy and promising technologies of the spindle system are suggested.

  • Innovation is the development of new customers value through solutions that meet new needs, inarticulate needs, or old customer and market needs in value adding new ways. This is accomplished through more effective products, processes, services, technologies, or ideas that are readily available to markets, governments, and society. Innovation differs from invention in that innovation refers to the use of a better and, as a result, novel idea or method, whereas invention refers more directly to the creation of the idea or method itself. Therefore, the utilization of patents is the most important of the three aspects (creation, protection and utilization) in the patent system for getting to actual innovation. In order to increase the patent use, the rates of the applied patents to a real industrial process and the bargain and license of patent rights should be promoted. For promoting technological innovation substantially, there is necessary to escape from dichotomy of weakening or enhancing patent protection in the discussion on the changes of patent system for "Adequate patent guarantees". Furthermore, the legal and institutional improvements to enable the use of patent should be discussed together. Recently, open innovation is a new paradigm that assumes that firms can and should use external ideas as well as internal ideas, and internal and external paths to market, as the firms look to advance their technology" or "Innovating with partners by sharing risk and sharing reward." The boundaries between a firm and its environment have become more permeable; innovations can easily transfer inward and outward. The central idea behind open innovation is that in a world of widely distributed knowledge, companies cannot afford to rely entirely on their own research, but should instead buy or license processes or inventions (i.e. patents) from other companies. In addition, internal inventions not being used in a firm's business should be taken outside the company. In the era of open innovation, more flexible patent use strategy is essential. It is important that improvements for the legal system in order that patented technology can be applied for products and processes in a real industrial between outside and inside of the firms.

Patent and Anti-wrinkle Cosmetics

  • In the 21st century, the development of cosmetics is led to pursue the high functionality of cosmetics with excellent effectiveness and safety. As Cosmetic Act took effect in 2000, functional cosmetics is provided in the law. As a result, the research and development of functional cosmetics has continually increased, and the number of patent applications in functional cosmetics has also rapidly increased as a plan for preoccupying in the functional cosmetics age. Now, the cosmetic industry has a great interest in developing anti-wrinkle cosmetics among functional cosmetics, because women's desire for having young resilient skin has increased since Korea entered an aging society thanks to the advanced medical technology. The patent application trends of anti-wrinkle cosmetics at home since 2000 particularly show the rapid increase in the applications in natural plant extracts. It may be because Korean consumers preference of vegetable cosmetics has resulted in the development of raw materials based on the traditional medicine. As for the existing preparation such as Retinoid or Ascorbic acid, the patent application itself will be an essential technical element in the future because patent applications are filed in the field of a preparation of cosmetics for stabilizing ingredients, reducing skin irritability or promoting absorbance, and in the field of cosmetic formulation technology. As there are many studies on the causes of skin wrinkles, it is expected that new raw materials of cosmetics can be developed due to new mechanisms, and that the number of patent applications in new technologies will increase due to a change in the thought of cosmetics accompanied by the integration of cosmetics with biotechnology using Genetic Engineering, including the practical application of the medicine previously used far treating skin diseases to an anti-wrinkle agent and the mass production of active ingredients of cosmetics.
