The Impact of Patent Infringement Litigation on Customer-Based Brand Equity

  • With continuous news headlines related to patents in the public media, awareness of patents' value is spreading, and patents are valuable not only to a firm but also to consumers. Therefore, this study makes an effort to explore the theoretical mechanism of the effects of patent infringement litigation (PIL) on customers. More specifically, this study examines the influence of PIL on customer-based brand equity (CBBE) and brand innovation image (BII). Based on this study's findings, PIL's outcomes directly affect BII, which in turn indirectly affects CBBE. That is, people will evaluate a winning brand as a highly innovative brand, which contributes to higher brand equity. However, in regards to PIL's direct effect on CBBE, there are some differences between Apple and Samsung. In the case of Apple, the winner image positively affects only one dimension of CBBE, brand loyalty, while for Samsung, the plaintiff's image negatively affects brand loyalty.

  • Patents is a strong asset. Samsung and Apple's patent lawsuit is a prime example. So many countries reinforce the intellectual property and they lay the emphasis on the patent. Utilizing the patent information efficiently is basic to the patent analysis. Patent information will provide for new science and technology information sources, international code is classified according to the international patent system IPC, being easily accessible. In this paper, analysis of foreign and domestic patents for zeolite technologies analysis using IPC. The current of technology development in such countries as Korea, USA, Japan, China and EU was analyzed by classifying the patents for 1992 through 2011 according to registration country, assignee, calendar year and technology area.

  • Technology forecasting is predict future trend and state of technology by analyzing the results so far of developing technology. In general, a patent has novel information about the result of developed technology, because the exclusive right of technology included in patent is protected for a time period by patent law. So many studies on the technology forecasting using patent data analysis has been performed. The patent keyword data widely used in patent analysis consist of occurred frequency of the keyword. In most previous researches, the continuous data analyses such as regression or Box-Jenkins Models were applied to the patent keyword data. But, we have to apply the analytical methods of discrete data for patent keyword analysis because the keyword data is discrete. To solve this problem, we propose a patent analysis methodology using Bayesian Poisson discrete model. To verify the performance of our research, we carry out a case study by analyzing the patent documents applied by Apple until now.

Analysis of Huawei's PCT Patent Applications (화웨이의 PCT 특허 출원 동향분석)

  • In this research, we aim to analyze the trend of Huawei's PCT patent applications. As a result of analyzing Huawei's PCT patents by dividing temporal spans into three periods - the early 2000s, the late 2000s, and the early 2010s -, the following characteristics have been observed. First, the number of PCT patent applications has conspicuously increased from the early 2000s to the late 2000s and this trend has continued during the early 2010s. Second, in terms of a core technological field, whereas Huawei focused on the development of technologies in the 'H04L: transmission of digital information' sector during the early/late 2000s, it changed this field to the 'H04W: wireless communication networks' sector during the early 2010s. Lastly, in the case of the patent maps, it was found that while general communications technologies, as expressed with such keywords as 'user' and 'network,' were actively developed during the early/late 2000s, mobile phone-related technologies grasped this leading position, as shown with the keywords including 'user equipment,' 'base station,' and 'MME,' during the early 2010s. It was also noticeable that Huawei filed LTE-related patent applications more actively than Apple and Samsung Electronics, which implies that it will presumably pioneer the global market more aggressively than its competitors in the future.
