The purpose of this study is to generate a proper regulation improvement direction of the public IT project contract law through the current four contract methods and three methods of the awarding party of a contract method. The research method for this paper is derived from the written materials of the present public IT project contract law. Two problems have been processed in order to produce the results: the current contract methods and the awarding party of a contract method. The current contract methods consist of a competition contract, a private contract, and a supply methodology contract. The methods of the awarding party of a contract display a qualified evaluation regulation, the 2nd step competition bid, a standard cost separation tender, and a contract by a negotiation. The results exhibit that the general competition contract consists of four improvement items. The contract by a negotiation contains five improvement items. The group private contract has one improvement item. And the private contract includes one improvement item. These results implicate that the current public IT project contract law demands better improvement work for the ubiquitous Korea.

PURPOSES : Case studies of an asphalt-overlay project with a performance-based contract method were conducted on a national highway in Korea to evaluate the effect of the method on asphalt pavement maintenance. This study evaluated the procedure of the performance-based contract method. METHODS : In this study, an asphalt-pavement maintenance project for a national highway was assessed with a performance-based contract to investigate the advantage of the new contract procedures. This is the first trial applying the performance-based contract to a pavement-rehabilitation project in Korea. In the four case studies, the warranty period of the performance-based contract was designed for seven years. The research team monitored the construction site to compare the normal contract method with the performance-based contract method. The case studies' project sites were investigated after the end of the construction. RESULTS : Based on the limited case studies, the performance-based contract method could extend the service life of the asphalt pavement and reduce the pavement-maintenance budget because the quality control was well managed by the contractors. However, a few construction laws would be necessary to apply the performance-based contract method in the future. CONCLUSIONS : Using the performance-based contract, the construction company made great efforts to guarantee the warranty period and to apply the optimal maintenance method, based on the pavement distress condition. The contractor and the agency would need to understand the new performance-based contract system for it to be activated. Therefore, a proper education program for the performance-based contract system would be needed to educate the stakeholders regarding the procedures and their effects on the pavement management and maintenance.

The selection of an appropriate contract method is vital for the successful operation of the project. However, there has been a lack of studies on objective decision making support models for use in the planning stage of a project contract. The present study had the goal of analyzing the factors that influence contract method selection, as an initial study for developing a project contract method selection model. The existing related studies were analyzed, and the factors considered in the literature were selected. Then, based on the findings, the opinions of an expert group on the important factors for contract method selection were collected through a survey. The collected opinions were analyzed using factor analysis, a statistical analysis method. The results will be utilized in the future as preliminary data for developing a decision making model for selecting a contract method.

본 연구는 실적공사비적산제도의 과도기적 문제점 분석과 이의 개선방안에 관한 연구의 기초 단계로 수행되었다. 이를 위해 원가 계산 방식과 실적 공사비 방식의 정의 및 구조를 알아본 후 세 개의 프로젝트를 대상으로 양 방식을 적용해 도급금액 내역서를 작성해 보았다. 이와 함께 현재 실재로 실적공사비 적산제도를 활용해 도급금액을 산정하고 있는 한국 S공사의 두 개의 프로젝트를 대상으로 공사측에서 제시한 금액과 원가견적방식으로 산출된 금액을 비교하였다. 이를 통해 실적공사비적산제도로 공사를 발주했을 경우 현재 방식과 비교해 도급금액이 어느 부문에서 어느 정도 변하는 가를 파악하였다.

In TWBP new uncertainty will be increased. Risk management is risen to a important problem. Vesting contract makes market Players trade at fixed price in TWBP early stages. In the case of advanced country, market players manage risk with a future contract. When a risk management method moves from vesting contract to future contract, it may have to use together two contracts for schedule period. In this paper, risk management strategy that use vesting contract and forward contract at the same time is proposed.

CM, EPC, PM 등과 같은 현재 국제적으로 많이 통용되고 있는 계약 방식들이 건설산업에 존재한다. 이러한 국제적인 건설계약 방식들을 도모하고자 중국 정부의 건설부는 2004년 새로운 건설계약법을 실행하였다. 이로 인해 중국내에서도 다양한 선진 건설계약 방식이 도입되고 있다. 한국은 중국과 비교하였을 때 실질적인 건설공사에 이러한 선진 계약방식을 도입함으로써 건설산업의 성장의 가속화를 이룩하였다. 이에 본 연구에서는 중국과 한국의 건설산업 및 계약방식 등을 비교함으로써 양국 건설산업의 차이점을 분석하고자 한다.

본 연구의 목적은 방위력개선사업으로 획득하는 국내 무기체계류중 대형 장기사업에 대한 사업추진단계별 계약형태 및 계약종류의 모델을 제시하는 것이다. 계약체결 요구시 계약관은 반복적으로 일괄계약, 분리계약 등을 검토한 후 계약형태 및 계약종류를 결정한다. 본 논문에서 제안된 모델 구성을 위해 선행 연구논문, 방위사업청 및 한국국방연구원 등에서 발행한 보고서, 계약에 관한 법령 및 각종자료를 활용하였고, 구)조달본부와 방위사업청에서 체결한 계약현황 분석 및 방산업체 의견을 수렴하였다.

Index adjusted ration method has been widely utilized in public construction secter for contract sum adjustment by price fluctuation. In this method. the Production Price Index are used for calculating the base ratio. but the PPI can't reflect the property of construction project in respect of the selected item and weight structure. In this research we prove the problem of using the index adjusted ration method in contract sum adjustment by price fluctuation. and improve it by using the construction cost index. which has the property of construction project. And the result. we figure out the difference between the PPI and CCI by $6.7\%$ in maximum value.
