A Study on Violence and Countermeasures on Cyberspace Corruption (부패범죄의 현황과 대책연구:사이버폭력을 중심으로)

  • This study focused on violent act, such as verbal offensive and other acts of violence such as cyber bullying, personal information infringement. Online bullying is seriously taking place online, as juvenile violence is seriously debated due to recent school violence. In particular, it is necessary to seek countermeasures by considering the nature of cyber violence in cyberspace, particularly when stalking victims in cyberspace have died from stalking. The study examines the problem of defamation and defamation of character and tries to identify problems. Measures were taken to enact cyber defamation laws. To this end, the Commission analyzed cases of defamation and defamation of character and considered legal precedents. The study intends to study cyber defamation and defamation of character. First, I want to differentiate between cyber libel and defamation of character. Second, I intend to raise the need for cyber defamation of cybercrime and consider the offence of contempt for the criminal justice system. Third, seek ways to protect against cyber defamation and defamation of character.

  • Cyber defamation is the act of damaging the reputation of the other person on the Internet, and the act of attacking by the commenting the article through a word or blog. The reason why punishment is stronger than general contempt is that the nature of crime about defamation is worse than contempt. Also, punishment intensity is higher than defamation because the nature of cyber information spreads widely. Honor is not only a question of self-esteem or identity, but also a function that economically reduces the cost of seeking information or socially trustworthy. Through these two functions, it has been developed as a legal system to protect the honor as well as asking the legal sanction for defamation. However, although honor is used in various meanings in everyday life, the honor of legal level is understood in a more limited sense. It is because the law cannot actively lead and protect all honor feelings for one's feelings or mood occurred by hurt. However, if the social evaluation of a group or individual is undermined through a certain distortion of the truth, the law will actively intervene. However, due to the ambiguity of the legal sanctions standards and the identification of the parties involved in the defamation of cyberspace, it was difficult to solve the problems related to defamation in fact. Therefore, this paper will try to find out the problems of civil legal remedy due to the cyber defamation, and seek a solution for civil legal remedy.

  • Defamation is one of the most frequently occurring daily legal violation because it can easily be done by words. In the internet generation with flooding internet forum websites and social network services, internet defamation is becoming one of the most serious problems in many leading IT countries including Korea and the United States. Being such a critical issue that can lead to a suicide, Korean policy makers has undertaken efforts to prevent the internet defamation by defining the liabilities of internet users and internet service providers. Many of the policies and laws including "the Telecommunication Information Usage Promotion and Security Protection Act of 2007" are modeled after that of the United States. Thus, the study aims to explore American defamation law and internet defamation law analyzing "the Communications Decency Act of 1996" and a recently decided precedent, "Brodie" case, in Maryland state court.

  • Precedents are data containing various types of information. In this study, I proposed a method to be utilized as legal information system for the public using automatic text analysis performed on precedents. It is carried out to analyze the defamation precedent using reference provision, judgment issues, major points of judgment, and reference precedents. As a result of the analysis, legal provisions used in defamation, key issues covered by defamation, and key cases are extracted. Although only applied to the Supreme Court case regarding defamation, the proposed methodology could be applied to various legal topics.

  • 사이버명예훼손이란 사이버공간에서 행해지는 명예훼손으로, 기존 명예에 관한 죄가 인터넷 등 사이버공간에서 행해지는 것을 말한다. 즉 오늘날 글로벌 커뮤니케이션 수단으로 활용되고 있는 월드와이드웹을 통하여 동시성, 의사소통의 쌍방향성, 접근의 용이성, 익명성의 특징을 갖는 사이버공간에서 나타나는, 사이버공간의 대표적 반작용 중의 하나이다. 이 연구에서는 사이버명예훼손과 관련된 개념 및 유형과 특성을 살펴보고 선진 각국의 입법례를 살펴본 후, 우리나라의 대응 방안과 관련된 시사점을 제시하고자 한다.

Effects of Cyber Defamation Victims' Post-Traumatic Stress on Coping behaviour : Focusing on the Theory of Reasoned Action (사이버 명예훼손 피해자의 외상 후 스트레스가 대처행동에 미치는 영향 : 합리적 행동 이론을 중심으로)

  • The purpose of this study examined how post-traumatic stress, caused when internet users in web portal or social media are defamed in cyberspace, influence on coping behaviour, through the Theory of Reasoned Action's two major factors: Attitude on behaviour and subjective norm. In so doing, it aims to provide a technical and political solution that would fundamentally prevent future victims in cyberspace. In an effort to examine its research theory, a survey was conducted on people who have had the experience of being defamed in cyberspace. The results showed, first, hypersensual has no significant influence over attitude on behaviour and subjective norm. Second, intrusion has no significant influence over attitude on behaviour and subjective norm. Third, avoidance showed significant influence over attitude on behaviour and subjective norm. Fourth, attitude on behaviour and subjective norm showed significant influence on behaviour. This study has both theoretical and practical significance; Unlike previous studies on cyber defamation with qualitative research method, this study employed quantitative method through theory-based approach. In other words, the researcher did not arbitrarily set variables, but utilized the Theory of Reasoned Action for examination.

  • Despite the increased social demand for strengthening the punishment for ghost surgery in Korea, the governmental management is very passive compared to other offenses of medical law, and the punishment for ghost surgery is insufficient, so that medical malpractices are continuously occurring. A plastic surgeon who posted the names of clinics performing ghost surgery and the number of deaths on the internet bulletin board, was charged with the violation of the Information Telecommunication Act(defamation). Thus, this study aimed to present the legal/institutional issues and implications of defamation by the release of ghost surgery, by initially examining the charged case after posting the contents showing the death of patients by ghost surgery in clinics on the internet bulletin board. This study aimed to understand how strictly the court approached the ghost surgery in the aspect of public interest, and also to understand the judgment standard of punishment for defamation by investigating the publicly alleging facts and public interest by the disclosure of ghost surgery. Moreover, this study aims to provide the basic data necessary for guaranteeing the national health right by arousing attention to ghost surgery.

Study on the Characteristic of Media Lawsuits by Public Figures and the Tendency of the Court Decisions in Korea: Focusing on the Decision about Defamation of Politicians and Senior Government Officials Since 1989 (공인의 미디어 소송 특징과 국내 판결 경향에 관한 연구: 1989년 이후 정치인 및 고위 공직자 명예훼손 판례를 중심으로)

  • Defamation lawsuits of public figures against media have been an issue since Roh government set in. Dissension between the government and media has probably acted as the key factor on this problem. Accordingly, arguments on the defamation lawsuits of public figures occurred the political issues such as opposition between the Progressive and the Conservative Parties or between the ins and the outs and showed the limits to suggest an appropriate judgment or solution. This study will analyze how the court makes its judgement on their rights and the limits by understanding the characteristic and the problem of defamation lawsuits made by senior government officials including a politician, the government, the president, and etc. As results, the defamation lawsuits of politicians and senior government officials showed specially noteworthy matters in salvation (damage suits), the amount claimed, court costs, ratio of winning lawsuits, and etc. The result on the tendency of the court decision showed the following matters in confusion: it holds the media responsible for the burden of proof by applying the inappropriate criterion; The applied laws, especially in the inferior court decision, do not show the consistency of the burden of proof between the misconception/ intention (malice)/ accident/ purpose of slander on the legal principles of public figures. Therefore, this study suggests the court to apply an appropriate law, let alone regulating the Anti-SLAPP law, so that it curtails the rights of public figures; limits the salvation of damage suit; and protects the right only in the case of false accusation by applying the existing law of "the Protection of the Deceased's Defamation Law." In order to dissolve the confusion when applying the laws on the public figures, the study insists the court to positively apply the Constitutional Court made criterion on "people" and "content." The study also insists to distinguish "intention(malice)," "accident," and "purpose of slander" and variant sorts of the burden of proof should be applied to each.

  • Defamation on the Internet is a criminal offense. Of late, the damage it has been causing has grown exponentially. Here, we suggest some ideas to expand the use of arbitration in Korea. We suggest that all disputes arising in connection with current contracts be settled under the rules of conciliation and arbitration. As a countermeasure to the requirements for defamation or damages, the field of criminal arbitration regulations needs to be defined strictly. In conclusion, the UK does not make provisions for arbitration as a specific subject. With respect to foreign legislation, it is necessary to take a look at ways to expand arbitration in our country. The scale of arbitration must be expanded to allow for greater protection of criminals in exchange for their cooperation in arbitration cases and relative to the amount of the damages in dollars. There must also be detailed instructions regarding the eligibility criteria for and proper handling of these arbitration cases.

Consumers' Perception on Legal Liability of the Online Reviews (온라인 사용후기에 대한 법적책임의식에 관한)

  • As hostile online reviews can have a negative impact on a company's reputation, it is not surprising that online reviewers and business owners often get involved in conflicts which sometimes evolve into legal disputes. This research examines the legal dispute case in which the business owner charges an online reviewer for a defamation. Further, this research compares the supreme court's decision with general public's view on this defamation case, using a survey method. From the legal point of view, an online reviewer's primary motive determines whether the online reviews are defamatory statements or not. Specifically, if an online reviewer's primary motive is to increase the overall benefits for the public society, the online review does not bear any legal liability. According to our survey, consumers' view aligns with the final decision of the supreme court. They believe that online reviews should bear a minimum level of legal liability as online reviews often contain useful and valuable information which can enhance overall public benefits.
