전자상거래 분쟁의 유형과 해결제도 (Type and Settlement System of Disputes in Electronic Commerce)

  • Like traditional commerce, disputes are bound to arise in the course of conducting an e-commerce transaction. At present of June 30, 2001, 259 cases of dispute on e-commerce have been applied for the mediation of Electronic Transaction Dispute Mediation Committee, types of them are 170 cases of delayed delivery of commodity, 21 cases of contract cancellation and refund, 16 cases of personal information protection, 16 cases of false and exaggerated advertisement, 14 cases of commodity defect. The settlement systems of e-commerce dispute are litigation and Alternative Dispute Resolution(ADR). ADR encompasses mediation, arbitration, and similar private tools for resolving disputes. ADR offers many perceived advantages. Speed of resolution and low cost are often cited as the primary benefits. Therfore e-commerce disputes may be settled more effectively by litigation. The settlement systems of e-commerce dispute by ADR are the mediation of Electronic Transaction Dispute Mediation Committee, the mediation of Consumer Dispute Mediation Commercial Arbitration Board, and the arbitration of Korean Commerical Arbitration Board. E-commerce sets up the probability that its merchants and customers will not exist in the same legal jurisdictions. The confusing application of laws and wide geographical dispersion of these parties will necessitate a faster and cheaper dispute resolution methodology. Therefore, online ADR may be effective for e-commerce dispute resolution. The examples of online ADR opetation are the cyber mediation of Electronic Transaction Dispute Resolution Committee, the cyber mediation of Korean Commercial Arbitration Board, the cyber mediation of Click N Settle, the online ADR of BBB online, and the cyber arbitration of virtual Magistrate.

공동주택 하자분쟁 조정제도의 활성화 방안- 기술적 쟁점사항에 대한 대응전략을 중심으로 - (Revitalization of the Conciliation System for Defect Disputes Related to Apartment Buildings - On the Technical Issue -)

  • 공동주택 하자분쟁을 해결하고자 하는 노력의 일환으로 최근 하자분쟁조정제도가 도입되었다. 하지만, 당해 제도는 현재의 하자분쟁의 쟁점사항과 분쟁 당사자들의 입장을 제대로 반영하고 있지 못하다. 또한, 제도의 내용과 절차에서 많은 미비점이 존재한다. 본 연구에서는 하자분쟁의 여러 내용적인 측면 중에서 기술적 쟁점사항에 대해 정리하고 하자분쟁조정제도가 정착되기 위한 대안마련을 검토하였다. 그 결과 현행 하자분쟁의 판정논리체계요소에 대해 정리할 수 있었고, 이에 효과적으로 대응하기 위한 전략으로서 활성화 방안을 제시하였다. 그 기본 원칙은 조정자와 분쟁 당사자간의 신뢰관계를 구축해야 하는 것이며, 사회적 기대사항에 대한 부합, 제도적 차원의 활성화 방안이 뒷받침되어야 할 것으로 판단된다.

  • The latest domestic construction sector is receiving economic damage because of defect litigation. The Concrete Crack among them has the largest component in expense of apartment house defect. Also, contradictory suggestion of appraiser is problem. To improve these problem, need objective plan that people concerned can recognize about decision sequence. Therefore, in this study, compared general defect investigation and defect decision of appraiser taking advantage of Data Dictionary analysis method. Also, deduced current problem and amelioration plan.

  • 공동주택의 하자감정과 관련된 다양한 문제점에 대한 개선을 하기 위하여, 본 연구에서는 선행연구와 관련기준 등을 분석하여 하자감정서의 분석체계를 마련하였다. 이를 활용하여 하자감정서 24건을 분석하였고 형식 요소와 질적 요소를 검토한 결과, 형식 요소의 경우 구성을 다소 변경하는 수준으로 손쉬운 대안을 제안하였다. 질적 요소를 분석한 결과, 감정인에 대한 평가제도와 참여기술자에 대한 전문교육제도의 마련을 통해 하자감정의 내실화를 강화할 수 있을 것으로 기대된다.

  • According to the dispute cases filed for claiming the collective defect repair fees, inter-layer concrete joints turned out to be the most frequently disputed item. For this reason, this study selects the inter-layer concrete joints to further analyze the primary causes and details of each dispute case. From the results of this study, three primary causes of the disputes are found, which are 1) the absence of standard specifications for construction quality control and management after construction; 2) the absence of established standards for repair when construction defects are found. In order to prevent construction defects in inter-layer concrete joints, this study provides three suggestions including 1) the current standard specifications for inter-layer concrete joints should be further specified by the Ministry of Land, Infrastructure and Transport; 2) a construction defect should be judged according to the compliance to the standard specifications; and 3) a clear and institutional protocol needs to be established for defect repair in cases that new public apartment houses have been judged to have defects.

  • As apartment buildings defect lawsuits become socioeconomic problems, an objective basis system for the term of warranty liability of reinforced concrete constructions is urgent. This study was carried out as a basic study for developing a basis system for the term of warranty liability. To do this, defect data actual collected in apartment complexes were collected and analyzed. As the result of checking the cumulative rate of defect occurrence in reinforced concrete construction by year, the point of time of reaching the 90% level was the 5th years, which was similar with the provision of the Apartment Building Management Act. However, the current Supreme Court precedent has decided that the term of warranty liability for the main structural parts in reinforced concrete construction shall be 10 years and the dispute is expected to continue in the future in the defect lawsuit.

  • The purpose of this study is to evaluate a defect in apartment buildings as review a safety investigation and consult a defect. As a result to compare a safety investigation to consult a defect, they are almost similar in spite of the purpose and the scope of evaluation are different. Therefore, it needs to establish a special and systemic system, and follow an organized effort about raising a consultant and improving an ability.

공동주택 하자소송의 발생형태 및 문제점에 관한 분석연구 (A Study on Types and Problems of Defect lawsuit on Apartment Buildings)

  • Recently, the cases of lawsuit are growing on residential defects. Though, mostly residential construction companies are trying to mitigate resident's dissatisfaction due to keep the company's brand image by operating customer service team, some representatives of apartment buildings initiate litigations without any negotiation with countrepartner companys incited by planned suit lawyers. But lawsuit takes longtime to sentence(about more than one year), and judged amount of money are very few (averaging about 14%) compared with asserted amount of it. To suggest the improving alternatives, the types and problems of defect lawsuit on apartment complex are analyzed.

  • There are main issues of defect type that condensation, concrete crack and noise in apartment buildings. Especially, according to the Apartment Defect Dispute Mediation Committee in Korea (ADDMC) at Ministry of Land Infrastructure and Transport in Korea (MLIT), condensation defects are great importance (14 percent) on whole number of reported cases of faults from 2015 in Korea. Most condensation defects have many different causes that take a toll on the resident's life and space. So it is very important to early detection and repair. For preventing the condensation in apartment buildings, there are building codes in Korea such as 'Standard of Method and Judgment for Apartment defect of investigation, Repair cost Estimate'. This research aims to study on the improvement of preventing the condensation aforementioned korea standard. Types and characteristics (opaque wall, windows, doors) of cause of occurrence and existing state condensation defect is analyzed from evaluation of real application 100 case in 2015 ADDMC data.

  • 신축 공동주택 보급률이 상승하면서 입주민 개인별 자산의 관리적 측면과 함께 품질에 관한 관심이 높아져 공동주택 품질과 관련된 분쟁이 급격하게 증가되고 있는 실정이다. 이에 본 연구에서는 분쟁을 저감할 목적으로 관리주체가 제소하는 집단하자보수비 청구 소송을 확인하여 가장 빈번하게 분쟁이 발생된 콘크리트의 층간이음부와 관련하여 각 사건별로 층간이음부가 차지하는 비중과 쟁점을 분석하였다. 그 결과 분쟁 발생의 원인에는 첫째, 표준시방서가 부재한 점, 둘째, 보수공법에 대한 표준이 없는 점, 셋째, 공동주택의 공통적인 사항이나 법원에서는 이를 관대한 개념에서 배상 범위를 인정하고 있는 점에 있음이 확인되었다. 이에, 하자예방을 위해서는 첫째, 층간이음부 시공에 대한 국토교통부의 표준시방서가 개정되어야하고, 둘째, 표준시방서 이행 여부에 따라 하자판정이 진행되어야 하며, 셋째, 하자로 판정 시 명확한 하자보수공법이 적용될 수 있는 제도개선이 필요한 부분임을 확인할 수 있었다.
