Analysis on the trends of Korean Medicine Pediatrics related patents (한의학 관련 특허 중 소아 관련 특허동향 연구 - 국내 등록 특허를 중심으로 -)

  • Objective : The purpose of this study is to analyze for the patent application tendency in Korean Oriental Pediatric Medicine. Recently, many studies are published in Korean Oriental Pediatric Medicine. However, in the patent area, the research results are few. Method : For patent analysis, we searched the database kipris (http://www.kipris.or.kr) which managed in the Korean Intellectual Property Office by keywords about Korean Oriental Pediatrics. They are technically analysed by year and IPC, patent's contents, main applicant and organization. Results : 1. Patents by year have been on the rise 2 in 1997 to 32 in 2011. 2. Our findings are Section A61;182, A23;46 in IPC analysis 3. In classification of content, 'application-food' is 67 cases, 'application-functional cosmetic' is 18 cases, 'application-clothes' is 5 cases. 4. Korea Institute of Oriental Medicine have 14 patent cases, that is the most patent agency in possession. Main applicants are person > company > university > laboratory > state or local government. Conclusion : This study shows that it has high frequency of daily necessity in patent cases about oriental pediatrics. The results are more distributed 'applied' field than 'treatment' field. The patent information should be connected research achievement results in Korean Oriental Medicine.

Herbal Patch Analysis in Korean Patent (국내 한방 패치 특허 현황에 대한 분석연구)

  • Objectives : The purpose of this study is to present trends and contents of herbal Korean Medicine patches by analyzing the herbal patches in Korean patents. Methods : Electronic search for herbal patch patents was conducted in KIPRIS (Korea Intellectual Property Rights Information Service). Korean patents that were registered by January 1, 2018 were selected in study. Patents that were not using herbal medicine or not related to patch were excluded in this study. The applicant, application date, International Patent Classification (IPC), contents and adhesive site of patches, target diseases, model of experiment and extraction methods were analyzed. Results : A total of 17 patents were included in this study. In applicant analysis, 61.5% of applicants were corporations. All IPCs in patents were involved in Section A (Human necessities & Agriculture) and 66.7% of IPCs were A61K (Preparations formedical, dental, ortoiletpurposes). In types of patch, 8 patents were hydrogel patches (47.1%), followed by 3 heating patches (17.6%). Skin related symptoms were the most targeted diseases (52.9%), Human was the most used model in experiments. Solvent extraction and hot water extraction were used frequently, and some patents had no limit for extraction were also existed. Conclusions : The study results will be helpful to diversify formulation of herbal medicine, to expand market scale of patent and to develop new application using Korean medicine. In order to establish sufficient data for utilizing patent technologies, more patent studies providing analyzed patent information are needed.

Patent Analysis of Sasang Constitution Medicine (사상체질의학의 특허 동향 분석)

  • 1. Objectives : The purpose of this study is to analyze for the patent application tendency in SCM(Sasang Constitutional Medicine). Recently, in SCM, many researches are made public through papers. However, in the patent area, the research results are less than the papers. 2. Methods : We collected patents about SCM using wintelips program. We analyzed patents according to the year, author, topic, and etc. 3. Results : We collected 151 patents using search system with wintelips program. After detailed analysis on SCM patent, we got to know that SCM was a growing field. In the collected patents, the patents on diagnosis technology were the majority and system of providing information were the second largest. 4. Conclusions : We think that the SCM field is growing at a fast pace with high activity, and this research should be updated annually.

  • This Study focused on IPC (International Patent Classification) for TKM (Traditional Korea Medicine) Paper. The results processed for 9,000 TKM paper by using 8th in IPC Classification. The name of Herbal Medicine assigned to IPC Classification, we assigned to two part for main-Classification(A61K) and sub-Classification (A61P). The results obtained about 77% for A61K and about 96% for A61K36 among them. And also analysed about 23% for sub-Classification(A61P) additionally. Main-Classification is distributed A61K > A61H37 > A61B5 > A61N > A61M1. Detailed Main-Classification for A61K is distributed A61K36 > A61K35 > A61K33 among Main-Classification. TKM Paper mainly analysed A61K36 and A61H37 in Main-Classification. According to the results. 'The Korean Journal of Herbology' has high-valued for Utilization as a Non Patent Document. we should constructed Database system for protection of intellectual property rights. And after We will registered minimum documentation of PCT.

  • Objectives: As treating acne is difficult and demands of cosmetic are increasing, the development of new Korea traditional herbal formulation and functional cosmetics of acne is required. The aim of this study is the discovery and composition for the development of new Korea traditional herbal formulation and functional cosmetics of acne. Methods: Searched patent informations related to herbal cosmetics published in 1996~2014, we extracted the patent information and analysis component about effecting of anti-inflammatory and anti-acne. Results: Out of 759 patent informations we searched, 72 those about effecting anti-inflammatory and anti-acne were selected. Also, 159 components of 72 patent informations were reclassified by frequency and characteristic. Conclusions: We expect the effect and safety of new traditional herbal formulation which is composed of high frequency herb in patent informations related to herbal cosmetics.

Analysis on Patent Trends in Traditional Korean Tea (한방차 관련 특허 동향 분석)

  • Objectives : The aim of this study is to analyze the patent trend in Traditional Korean Tea. In this paper, we investigate the diversity of Korean Tea registered as patents focusing on the kinds of medicinal herbs used, processing methods, and types of tea. Methods : We collected patents data using KIPRIS, and WIPS database. We conducted Quantitative Analysis by year and main patentee, and Qualitative Analysis by patent's contents. Results : 313 patents are selected from 2001 to May 2017. The number of patents have been on the rise and reached 44 in 2014. Individuals have registered the most patents, followed by companies, Industry-University Cooperation Foundation, and local autonomous entities. Ginger, Omija and Cactus were used at high frequency among 109 tea containing one medicinal herb. Licorice and Jujube were frequently used among 204 tea containing more than two kinds of medicinal herbs. In classification of patent by efficacy, 'health promotion and function recovery' and 'treatment and prevention of diseases' are most frequently specified. 128 patents are presenting processing methods for medicinal herbs in the order of roasting, fermentation, and fumigation. Among 164 patents presenting tea types, liquid type accounts for more than half and there are 67 leached tea, and 32 powder tea. Conclusion : The analyses results showed that lots of new recipes, efficacy, processing methods and tea types are being studied and registered as patents. In order to help Traditional Korean Tea industry to develop, active patent registration and further study about up-to-date patent trend would be required.

Analysis on Patent Trends in Nonthermal Processing Technologies for Medicinal Herbs (한약재 가공 기술의 특허 동향 연구 - 비가열 가공 기술을 중심으로 -)

  • The purpose of this study was to analyze the patent application trend in the processing technology for medicinal herbs. Recently, in processing technology for medicinal herbs, experimental researches have frequently been published through papers in journals. However, the research results about the patent area were fewer than the others. We tried to analyze the patent application trend in nonthermal processing technologies for medicinal herbs by country as Korea, Japan, U.S.A. and Europe. The detailed technologies consisted of pulsed electric field, oscillatory magnetic field, intense pulsed light, ultrasonification, high hydrostatic pressure, microwave, radiation, Ohmic heating, and supercritical extraction. As a result we found that patents of nonthermal processing technologies has been growing steadily in quantity from 1980s and growing quickly since 2000s. The number of patent in Korea is larger than others as making up 70% in that whole. The number of patent in ultrasonification field was larger than others in portfolio analysis. Patent application trend in nonthermal processing technologies for ingestion occupies high share compared to other usage applications. In conclusion, patent trends of nonthermal processing technologies for medicinal herbs belong to the period in the development.

Analyzing Patent Trend of Mibyeong (미병 특허 동향 조사)

  • Objective : The purpose of this study was to analyze for the patent application tendency in mibyeong. Mibyeong is a concept in Korean Medicine meaning sub-health state, and treatment of mibyeong can be understood as preventive medicine. This concept laid a foundation for the development of Korean, Japanese and Chinese traditional medicine. In this paper, we describe a meaningful data for efficient R&D through patent analysis of mibyeong focusing on the Korea, Japan and China. Method : We collected patents about mibyeong using Focust, IPDL search tools. We analyzed patents according to the year, topic, country and etc. Results & Conclusion : We collected 1,577 patents and selected 807 patents as useful patents. After detailed analysis on mibyeong patent, we got to know that research about mibyeong was a growing field. In the collected patents, the patents on treatment device(except treatment compositions) were the majority and system of providing information were the second largest. We think that the mibyeong field is growing at a fast pace with high activity, and this research should be updated annually.

Analysing of the recent trends on the constitution diagnosis and treatment device patents (체질진단 및 치료기기 최신 특허동향 분석)

  • In this paper, We tried to analyze the patent trend on constitution diagnosis and treatment related technologies. For this, constitution diagnosis and treatment related technologies divided into 16 sub-technology by the advisory committee. And we analyzed patents applied in Korea, Japan, U.S.A., China, and Europe. The 16 sub-technology consist of pulse analyzer, skin diagnosis, tongue analyzer, face and body detector, face analyzer, voice analyzer, intelligence ontology, meridian diagnosis, infrared thermography, electric stimulation, laser, high and low frequency, physical, magnetic, and ultrasound therapy. As a result we found that patents of constitution diagnosis and treatment in Korea has been growing steadily in both quality and quantity since 1980s. The number of patent the pulse analyzer and low frequency therapy are larger than others. But applied relevant international patents, marketability of the patent and Cites per Patent (CPP) index are shown to be very low. In conclusion, to occupy key original technologies of the Oriental medical device, we need to apply more patent of the whole related technology and international patents.

  • Recently, more and more natural herbal products are investigated and used popularly. Pharmaceutical companies of Korea are very interested in developing herbal new drugs. And oriental doctors also need popular, modernized form of oriental drugs. The objective of this article is, first, to examine current situations of drug development in Korea, second, to know general concepts of patent and third, to think about new drug development and patent in oriental medicine's point of view. With consideration of oriental medicine's characteristics, concepts of new drug and patent should be improved. Therefore, the oriental pharmaceutical industry and developments of oriental new drugs could be inspired to further efforts.
