Japan's implication & strategy to the TSR corridor (TSR에 대한 일본의 전략과 시사점)

  • Japanese government actively took part in the TSR modernization. the amount of trade between Russia & Japan increased increasingly by 55%, as the individual income increases in Russia, it becomes a big scale consuming market, therefore Japan concentrates on lobby to push into the russian continent and also Japanese government will participate in aggressively to the cooperation with Russian government, loaning to the TSR modernization & trade insurance, high speed train introduction, and introduction of transport system. this study checks and analyzes the japan's concrete methods & strategy to advance to the continent, and also this case can be applied to South korea, if TKR corridor is continuously blocked. I want to review the cooperation of north & south, and the project of continental railways.

Promotion strategies for consumption of the fairly traded products (공정무역 상품의 소비를 활성화하기 위한 방안 연구)

  • Fair trade has received increasing attention from ethical consumers in the North Trans-Atlantic world. It is a movement establishing alternative trading organizations to ensure minimal returns, safe working conditions, and to provide continuity in the trading relationship for disadvantaged producers, especially women and indigenous people in the South. Despite of the growing fair trade movement in the U.S. and Europe, it is still in the introductory stage in Korea. Although fair trade has gained some attention because of the efforts of activists, most Korean consumers are still unaware of it. This paper is divided into four sections including an introduction and conclusions. In section two, I analysed sales of the fairly traded products and the websites of the fairly traded products sellers. In section three, I proposed two effective recommendations for the better marketing and promotion strategies of fairly traded products. One proposal is for providing consumer information, like fair trade certificates, consumer campaigns, and consumer information of the fair trade sellers' websites analyses. The other is for establishing the infrastructure to promote the consumption of fairly traded products such as consumer education, corporate social responsibility, social enterprise, fair trade town and school, and networking. This study is relavant to academics, non-profit fair trade organizations, manufacturers, retailers and governments.

  • Purpose - This study investigated competitive counteractions necessary for continuous growth in a rapidly changing logistics environment in Northeast Asia. Research Design, Data, and Methodology - Using a time series analysis, the study first investigated Northeast Asian trade scale and volume by examining online and offline material from the Ministry of Ocean and Fisheries, Busan Port Authority, and other government agencies. A literature survey was done to investigate the state and prospect of the logistics environment in Northeast Asia including changes in freight volume at major ports in the three Northeast Asian countries. Result - The results of the study suggest using the Trans-Korean Railroad (TKR), as well as promoting the North Pole and South Pole routes, to compete against changes in trade volume and the logistics environment in Northeast Asia. A SWOT analysis was done to examine the effectiveness of these strategies. Conclusions - The findings indicate that the TKR impact, using the Busan Port connecting the Trans-China Railway (TCR), the Trans-Siberian (TSR), and the North Pole Route, may be uncertain in practice considering the uncertainty in international politics.

A Comparative Study on the Selection and Discharge of Arbitrator(s) among Korea, China and America (한.중.미 중재인의 선정 및 기피에 관한 비교연구)

  • China and North America have been South Korea's biggest trading partner long time. As the volume of trade has been increasing, the disputes between Korean companies and Chinese Companies and between Korean companies and North American Companies have been increasing. If these disputes are settled by Arbitration, the parties appoint arbitrators who are empowered to proceed the arbitration procedure and have a power to render an arbitral award. Accordingly, it is very important for the parties to select who is an arbitrators in Arbitration. But if the parties doubt their arbitrator(s)'s fairness and independency, they can discharge them in accordance to law and arbitration institute's rules. In comparison with arbitrator system for way of selection and discharge among Korea, China and North America, some differences are found. First, if parties fail to appoint co-arbitrators or the presiding arbitrator by a mutual agreement, the court has the right to appoint them or him in Korea and North America whereas the Chairman of CIETAC choose him in China. Second, the authority to decide whether arbitrator is discharged owing to his fairness and independency, depends on arbitration institute and court in Korea and North American whereas it depends on the Chairman of CIETAC only.

Dispute Resolution of West and East German Trade and Internal-Korean Economic Relations (동서독 상사분쟁해결방안이 남북한 분쟁해결에 주는 시사점)

  • From the reunification of Germany we can learn much for the reunification of Korea. That particularly applies for the dispute resolution of the trade relations between both states. The domestic trade relation, which was the only contractually regulated relation between two states for a long period of time, played a crucial role in the reunification of Germany, In this research paper, we examine how the economic disputes in divided Germany had been settled, and consider for the amicable economic relations between south and north Korea, what can we learn from that. In Germany, the disputes from the trade relations could be settled via the civil procedure, because the judicial codes of both German states were the same until 1975, However, that does not apply in Korea, as two Koreas have another law and another court system, from the start. We argue that arbitration is the best way for the completion of the economic disputes. Besides the general advantages of the arbitral procedure, the arbitration is particularly suitable to regulate the economic disputes from Korea-Korea relations, because of glaring differences of the legal status and reality of both countries. Furthermore, the standing arbitral tribunals would be in the economic relations between two Koreas more effectively than the ad-hoc arbitral tribunals. The ad-hoc arbitration generally requires a lot of time to setting up an arbitral Oibunal. For the rapid and obligatory settlement of dispute, the Convention of Currency, Economic and Social Union between West and East Germany 1990(Staatsvefrag zur Wahrungs-, Wirtschafts- und Sozialunion zwischen der Bundesrepublik und der DDR) also planned the institutional arbitration. The organizational support of the internal-Korean arbitration can take place via already existing institution, namely in south Korea 'The Korean Commercial Arbitration Board' Periodic decision reports and publication of substantial awards at the early stage seem appropriate.

Trans-Korea Rail Logistics Strategy for the Normalization of South and North Korea Economic Cooperation (남북경제협력 정상화를 대비한 철도 물류망 구축 방안)

  • It is essential to connect the railroads between South and North Korea in order to the implementation of the Eurasia initiatives and prepare for the normalization of the economic cooperation between south and north Korea as well as the unification. This study provides the strategy to establish the rail logistics network for the normalized trades between south and north Korea, and the accommodation of the logistics demands to China and Russia. The alternative routes were designated and the costs for the rehabilitation were estimated, and suggested the priority for the investment. The Trans-China Rail is prior to the Trans-Siberia Rail in terms of the utility for the logistics and the political value. In connection to the TSR, it is desirable to pass the Seoul-Gyeonggi area where the demand is greater than the other area. This route is limited by the restriction in the capacity, then the Gyeonggi Ring Rail route may be necessary.

The Devices to Strengthen the Competitiveness of the Port of Busan Relating to the Change of Logistics Environment in North-East Asia (동북아 물류환경변화에 따른 부산항의 경쟁력 강화 방안)

  • With trend of container ships becoming larger and faster, the environment surrounding ports in North-East Asia is rapidly changing. Korea's largest port of Busan processed more than 10 million 20- feet equivalent containers in 2003, surpassing the 10-million TEU mark for the first time in its three decades of operation. However, the Port of Busan , the world's third-largest port in 2002, was eclipsed by Shanghai since July in 2003. The first massive strike of truckers crippled the Korea's logistics system in May and in September, the Port of Busan suffered from the second strike of truckers and damage by a powerful typhoon. By contrast, the port of Shenzhen in China increased its container-processing volume by 39.9 percent to 10.65 million TEU in 2003, and Shanghai, which passed Busan in terms of container volume in the middle of last year, further consolidated its position as the world's No. 3 port with an annual volume of 11.28 million TEU. After all, Busan recorded an annual container volume of 10.40 million TEU, slipping to fifth in rankings in 2003 and Busan's bid to become a Northeast Asian hub has suffered a further setback as these chinese ports overtook the port of Busan. But the port of Busan is located in the main trunk liking North America, Europe and South-East Asia. Once the project of Busan Newport is accomplished and the railway between South and North Korea is connected to TCR and TSR, the Port of Busan will have the most potential to become the international logistics center as the starting point of the land and sea routes encompassing all over the world.

An Ecological Reflection on the Food Self-Sufficiency Debate of the Antebellum American South (남북전쟁 이전 미국 남부지방 식량자급 논쟁의 환경사적 검토)

  • The antebellum American South has been characterized by the lingering backward images of plantation, slaves and cotton. The South specializing in the cotton cultivation is compared with the manufacturing East and the breadbasket Midwest. Douglass North who examined the interregional trade assumed that the South up until 1860 relied on the Midwest for the foodstuffs. Statistical and literary evidence, however, disputes the North's model, showing instead that the southern region attained self-sufficiency in foodstuffs at least in the late 1830s or early 1840s. The South's food self-sufficiency is attributable, to a greater extent, to the region-wide environmental movement of scientific agriculture launched to address the aggravating soil problems from cotton monoculture. Diversification and crop rotation lied in the center of the new regime. The new agricultural system combining com, cotton and cowpea ensured the procurement of hoecake, hog meat, and cotton. The most significant outcome of the good farming regime, however, was the enhanced environmental consciousness which came to prevail the best farmer's reckless rush for profit maximization.

A Comparative Study on Arbitration Law of Some Countries in the North-East Asia (동북아 주요국의 중재법제 비교연구)

  • The purpose of this thesis lies on building the foundation for the further activation of trade among the Northeast Asian countries such as South Korea, Japan, China, Russia, and North Korea through an analytical comparison of their arbitration systems. Further activation of trade cannot be reached without previously building safety measures on the negotiation of exports, the control on defective imported merchandise, the returns on investments, and the stable management of businesses. Throughout this thesis an analytical comparison of these five countries' most important areas on arbitration will be carried out. These areas are the arbitration laws and organizations; the structures of the laws; scope of arbitration; form of arbitration agreement, appointment of arbitratiors, place of arbitration, hearing, court assistance in taking evidence, governing law, decision making by panel of arbitrators, form and contents of awards, effective of award, recourse against award, recognition and enforcement of awards. etc. It was found in each of the areas cases to be identical, similar or verydifferent; also, cases unable to arbitrate. This phenomenon was found to occur due to the differences in political and economic systems and perception of arbitration among these countries. Additionally, this thesis points out what should each country do for its integration. It is also suggested the organization of a common arbitration research body to continue the efforts for raising the awareness, building trust, and mutual recognition among the countries to ultimately create a common arbitration system. Lastly, it is a personal will that this thesis will serve as the starting point for in depth researches in each of the presented areas.
