A Study on the Policy Solutions to Prevent Abuse of Patents : Focusing on Patent Ambush (특허권 남용예방을 위한 정책방안 연구 : 특허매복행위를 중심으로)

  • Recently, a patent holder of a technology that has been selected as a standard has caused considerable difficulties in enacting and using a patent technology standard as a patent ambush act that abuses the right. Major countries in the world are preparing legal grounds to prevent patent ambush, but in Korea, legal binding is very limited. Therefore, in this study, various proposals were attempted to prepare problems and policy solutions related to patent ambush in standard patents. In particular, we investigated issues and cases related to domestic and foreign ambush patents, it is considered that it is necessary to prepare a legally available device, clear standards for abuse of FRAND patent rights, and a patent compensation system to prevent patent ambushing.

A Study of Patent Document Processing by SGML (SGML을 이용한 특허정보처리 연구)

  • A description of SGML(Standard Generalized Markup Language) is given together with a detailed description of WIPO Standard ST.32. The benefits of the use of SGML are highlighted-its system Independence and flexibility in building publication systems and full-text databases. A structure of WIPO Standard ST,32 based patent content is defined by DTD(document type definition) written in ST.32, and full-text itself is described with generalized markup depending on DTD. This article explains how to represent a document structure : a hierarchy structure like a entire document, a specific, sub-document, a paragraph, or non-hirarchy structure like a table drawings, or chemical structures. Merits of SGML In patent document processing are also discussed.

  • As market becomes global, international standardization is more critical for the success of businesses and countries. Especially in the field of ICT(Information and Communication Technology), standardization is more important. Businesses not only try to expand the standard favoring them, but also they try to include their IPR(Intellectual Property Rights) such as patents into the standard. By doing these, businesses can increase their share in the market. In this paper we consider the patents included into the standards of ITU-T and IEEE which are major international standards development organizations(SDO) in the field of ICT. The patent analysis is a meaningful research topic because it helps us to understand the current status and future directions of patent activities. We investigate the patent database with respect to the nationality and institution of patent owners. The results of patent database analysis are included and some comments are presented.

  • Patent information, which is generated under a specific, objective rule for a prolonged period of time, has the properties of technology, right, and management. Because of these characteristics of patents, patent analysis is used to identify R&D capacities and performances, and management strategies of a given nation or enterprise. In this paper, we analyze LTE essential patents which are key IPRs for implementing standardized LTE technology and major weapons in a global patent war. Also, we discuss the status of standard patent data, main applicants and standardization trends based on declared in ETSI standard patents. Especially, we analyzed 15,073 patents data which are possible to analyze patent information.

  • As Shapiro and Varian argue the open approach generates bandwagon effects and facilitates the diffusion of a standard thanks to network externalities. However, the open approach is not linked automatically to economic benefits as suggested by some famous cases as the IBM PC history. On the contrary, the closed approach enables a tight control over a technology and its development, and insures the appropriation of economic benefits. As Shapiro and Varian suggest, a firm can also decide to mix an open approach with tight control over improvement or extentions. Patent pool is to offer fair, reasonable, nondiscriminatory access under a single license to patents that are essential for the use of standards-based or other platform technologies. patent pool offers only one license to everyone, Since each patent is essential, the royalty rate and thus the value is the same whether a licensee uses one or more patents.

  • Recently, International Standardization is an important issue in competitive world market because of integration of standard, liberalization of international trade and globalization. Consequently, Korean companies need a strategy about corresponding to market circumstance and global standard. In this study, we examine Intellectual Property, Patent and Antitrust Law which are related to standardization. This study suggests company strategy and system integration model to dispose the global standard.

  • This Paper reviews various formats of patent numbers that unique identifier of patent document according to country. And it describes standard DOI model that can unify each country's serveral patent numbers. Based on this patent DOI, it describes implementation method to link digitalized patent document to patent bibliographic record at a time.

  • This study aims to establish an efficient future technology development strategy in the information and telecommunications industry by grasping related technology trends and fusion complexity through an analysis based on standard patents. Analyzing 1,983 patents related to the information and telecommunications industry identified the trends in major patent applicants and detailed technologies in the world. In addition, technology trends were investigated through keyword analysis to examine the degree of complexity in information and communications technology, confirming the direction of research in information technology. Electronic component and wireless communications fields have relatively few standard patents, but they are highly convergent with other industrial technologies. Computer information processes and communication and broadcasting technologies are highly related to each other, so they can be used as standard fusion technologies in standard patents. In addition, standardization activities in optical and image/sound devices are found to be high.

Technological importance and breadth of standard essential patents: A comparison between practicing and non-practicing entities for mobile telecommunication technologies

  • Using 23 867 standard essential patents claimed for three different wireless telecommunication standards (GSM, WCDMA, and LTE), this research examined the difference in technological importance and breadth of patents between practicing and non-practicing entities. We discovered that compared to manufacturers and service providers, organizations who do not appropriate innovation-derived profits directly from product or service markets tended to have relatively low-quality but broadly scoped technologies for the claimed standard essential patents. These relationships between the characteristics of inventions and the organizational types were consistently held across different generations of wireless standards as indicated by regressions run for each sample split by generation. Furthermore, the theory and policy implications of our results and arguments are presented herein.

  • RFID technology as a typical convergence technology combines RFID communication, mobile communication and network infrastructure, and information processing technology. As it enables users to communicate with the surroundings, RFID technology is now recognized to serve as the basis technology for the ubiquitous information society where users can get the needed information anytime and anywhere. Through lots of efforts for the early technology development and standardization activities on RFID technology, Korea has been leading technology standardization as well as technology initiatives. Thus in this paper, we discuss the RFID technology trend by analyzing RFID standard patent data which is declared in international organization for standardization (ISO, IEC, ITU). Especially, we analyzed 906 standard patents data that declared in International organization for standardization (SO, ISO/IEC JTC1, ITU-T) on June 2013.
