2010년부터 턴키심의위원 풀 제도를 폐지하고, 상설심의위원 제도를 도입하여 현재까지 턴키입찰공사는 설계적합최적가방식, 종합평가방식으로서는 입찰가격, 설계점수조정, 가중치기준, 확정금액최상설계방식의 5가지 낙찰자 결정방식으로 선정하고 있다. 또한 낙찰자 결정방식으로서 설계심의분과위원회를 크게 중앙 지방 특별 설계자문위원회의 분과위원으로 구성하여 운영하고 있으나, 아직 로비 부담에 대해서 개선되지 못한 것은 심의위원 풀제에서 상설심의위원으로 심의 주체만 변경되었을 뿐, 턴키입찰에서 설계심의가 가지는 비중과 설계심의방식도 과거와 유사하기 때문이다. 그러므로 가격경쟁을 부분적으로 강화하여 설계점수가 낙찰을 좌우하는 풍토를 개선하고, 기술경쟁은 영업력보다 실질적인 기술력이 경쟁력을 가질 수 있도록 설계심의제도를 개선하는 것이 필요하다. 이에 이 연구는 낙찰자 결정방식의 설계심의 운영제도와 문제점 그리고 개선된 설계심의방안을 제시하였다.

This study is concerned with the development of a project management system for the turnkey-based plant project, which will help the site manager to plan, control, and report the project progress. This system has been developed as one of the modules of the integrated information system for the H Heavy Industry Co. and is composed of five subsystems; project information system, drawing-material management system, process management system, project progress report system. A/S management system. it also integrates commercial project management package in order to schedule the project activities and report the project progress to the owner. The main purpose of the system is to provide project information, including drawing, material, and progress, to the site manger in the real time and to accumulate site know-how for the turnkey-based plant project.

Turnkey contract system is an effective ordering system for the ordering organizations that technical engineers are insufficient for their construction projects. It is possible to reduce project duration and to improve project quality in an integrated contract system between design and construction. However, owners can have a difficulty caused from unitary responsibility system. This study analyzes present situation and problems of turnkey contract system including railway projects. The result includes various methods for improving the system based on the analysis of bid price and selection procedure.

과거에 시행한 심사제도는 입찰참가자격사전심사 및 기본설계평가와 가격평가로 구분하여 최종 낙찰자를 선정하였으나, 2010년 1월 1일부터 현재까지 턴키 대안입찰공사는 설계 적합 최적가 방식, 종합 평가 방식(입찰가격조정, 설계점수조정, 가중치기준), 확정금액 최상 설계 방식의 낙찰자 결정방식을 선택하고 있다. 이러한 제도적인 문제로 발주기관은 동일 유사한 공사에 대해 서로 다른 낙찰자 결정방식을 적용하고 있는 사례가 종종 있어 왔다. 그러므로 이 연구는 국내에서 시행된 토목부분 턴키 대안입찰공사 발주현황, 건수 및 수주실적, 공종별 발주기관별 수주실적, 세부방식 가중치 낙찰자 수주실적 등의 분석을 통해 국내 턴키 대안입찰공사 실정에 적합한 낙찰자 선정기준을 제시하였다.

This article examines the Practical Suggestions in the Contract for the Turnkey Supply of an Industrial Plant based on a study focused on the commentary of "ICC Model Contract" clause which is encouraged by ICC. Especially practical issues are inquired into on business and legal perspective as follows. First, in regard to supply of technical documentation, equipment and spare parts, it is important to supplier and purchaser to agree on obtaining technical documents necessary for installing and operating plant, and also components necessary for it's maintenance. Second, it is about erection, testing, taking over and training chapter. Both parties need to agree about the process of the arrival of equipments and assembly conducted by the supplier and following examination and also training purchaser to operate it Third, when it comes to price, payment conditions, bank guarantees, parties are to make decision on the pricing, payment conditions and currency of contract-payment. Lastly, it is necessary to reach an agreement of the issue of whether it is to be defined as delay or non-performance of the contract and also it's consequences about rights and obligation.

2010년부터 2013년까지 낙찰자 선정방식이 설계적합 최저가방식, 종합평가방식(입찰가격 조정, 설계점수조정, 가중치기준), 확정금액 최상 설계방식으로 변경되었다. 따라서 이 연구는 국내에서 시행된 변경된 방식에 의한 토목부분 턴키 대안입찰공사의 발주현황, 건수, 수주실적, 낙찰률 범위, 공종별 발주기관별 수주실적, 가중치 낙찰자 수주실적 등의 분석을 통해 국내 낙찰자 결정방식이 건설산업에 미치는 영향, 심의 발주방식 및 운영상의 문제점을 분석하여 제시하였다.

전통적으로 주요 EPC(설계, 구매, 시공) 공사는 최초의 엔지니어링 작업(FEED : Front End Engineering Design)을 한 후, 경쟁입찰을 하여 총액계약(Lamp Sum)으로 공사를 수행했다. 최근에 EPC시공자의 위험부담을 줄이는 한편, 발주자는 경쟁적인 시공자를 확보할 수 있는 기회를 확대하면서 협상기간을 단축하교 조기착공을 위해, Lump Sum 가격을 늦게 결정하는 방법을 고려한다. CLST(Converted Lump Sum Turnkey)계약방식은 최초의 엔지니어링 작업을 한 후 경쟁입찰을 통해 1차 계약을 맺고(설계 및 특별 자재 공급에 대한) 공사를 수행하다 설계가 충분히 진행되고 핵심자재에 대한 견적이 입수되어 발주 가능한 시점 및 하도급사를 선정할 준비가 된 시점에서 1차 계약을 변경해 2차 계약을 맺는다. 2차 계약 시 1차 시 맺은 계약조건(직접공사비, 일반관리비 및 이윤, 최대한도 금액이 포함됨)을 기준으로 하되, 발주자가 Open Book 형식으로 공사비를 평가하고 재협상하여 Lump Sum 금액으로 전환해 합의한다. 이후 Lump Sum Tumkey 계약과 동일한 형식으로 공사를 수행한다.

As a recent global trend, the majority of plant projects are delivered through EPC or EPC-turnkey contracts, where a contractor's liability is more complicated because of the mega size scale and financing method. Previous researches have been lacking a practical usability for project members for liabilities of contracts. Those were focused on solving the claims or schedule calculation issues only. The objective of the present study was to develop a validation process for LDs (liquidated damages) in contractor's liabilities with various case studies and expert judgments. As summarized in this paper, the processes and tools were developed with project life cycle process. The project preparation phase includes 3 step check lists to determine the Go or No-go for projects. In progress phase, contractors should focus on the response strategies for claims with liabilities. The study concludes that those developed processes and tools will help to manage risk of LDs for the contractors in the overseas projects.

양산 부산대학교병원 건립공사는 종합병원 의료타운 신축 프로젝트이다. 계획단계부터 건설사업관리자(CMr)가 참가하여 설계 시공일괄사업자를 선정한 후, 실시설계 진행과정을 거쳐 시공단계, 시공이후단계에 이르기까지 프로젝트의 모든 단계에 건설사업관리(CM) 업무를 일관적으로 적용한 사례이다. 또한 설계와 시공의 추진에 Fast Track을 도입하여 공기단축에 성공한 것에 그 의미를 찾을 수 있다. 본 사례는 설계 이전단계에 설계시공일관업체를 선정하였으며, Fast Track수법의 적용을 염두에 둔 설계 및 공사일정계획, 설계단계의 설계관리, Fast Track에 입각한 단계별 공사발주 및 계약관리, 기본설계 실시설계단계의 VE 수행, 시공단계에서의 설계변경 관리, 시공 후 유지관리 단계의 운용관리 등 건설사업관리 업무가 모든 단계에서 다각적으로 제공되었다. 본 보고에서는 상기와 같은 건설사업관리 적용상의 과제와 개선방향, 특히 설계 시공일괄사업에서 효율적으로 CM 업무를 수행할 수 있는 방안을 제시하여, 초대형 턴키(Turnkey) 프로젝트의 CM적용에 기여하고자 한다.
