FTA 원산지정보 관리체계 개선방안에 관한 연구 (The Study on Improvement Plan of FTA Origin Information Management System)

  • 한-칠레 FTA발효 이후 10년 이상의 기간이 경과하였음에도 아직까지 국내거래단계에서의 원산지 정보 유통과 관리는 FTA활용 이익의 수출자 편향성과 발급유인 부족 등의 원인으로 원활하게 이루어 지지 않고 있다. 또한 발급 유통되고 있는 원산지증빙서류의 경우에도 정확성이 담보되지 않아 최종 수출자가 발급하는 원산지증명서에 오류를 유발할 수 있는 등 다양한 문제를 내포하고 있다. 이에 본 연구는 원산지(포괄)확인서의 발급과 유통을 장려할 수 있는 방안과 유통되는 국내거래단계 원산지정보의 정확성과 신뢰도를 제고하기 위한 방안을 찾아보았다. 이를 위해 본 연구에서는 우리 기업들의 원활한 FTA활용 지원을 위해 국내적 영역에서의 원산지(포괄)확인서의 유통 활성화와 오류 방지를 위한 제도적 보완책과 최종 수출자의 의도하지 않은 원산지증명서 오류로 인한 손실방지책의 도입방안을 제시하였다.

일반음식점의 쇠고기 원산지 표시에 대한 소비자 인식 연구 (Research on Consumer Awareness Due to Origin Declaration of Beef in General Restaurant)

  • 2007년 현재 한 미 FTA 협상 결과에 따라 미국산 수입 쇠고기의 개방이 본격화되면서 국내 외식시장의 변화가 예상되고 있다. 이에 국내 외식시장은 '쇠고기 원산지 표시제의 정착'과 '국내산 한우와 수입 쇠고기에 대한 소비자 니즈의 충족'이라는 당면과제를 안고 있다. 이와 같이 조사 분석된 연구 결과를 요약하면 다음과 같다. 첫째, 일반음식점의 쇠고기 원산지 표시에 대한 소비자 인식 수준은 비교적 낮은 것으로 나타났다. 둘째, 수입 쇠고기를 선호하는 이유는 한우에 비해 맛은 떨어지지만 가격이 상대적으로 저렴하기 때문인 것으로 나타났으며, 일반음식점에서 판매하는 국내산 한우에 대한 불신감이 큰 것으로 분석되었다. 셋째, 국내산 한우는 맛의 우수성, 안전성, 신선도에서 높은 평가를 받고 있는 반면, 수입 쇠고기는 모든 속성에서 보통 수준 이하의 낮은 평가를 받고 있었다. 이와 같은 조사 결과를 토대로 판단해 볼 때, 쇠고기의 원산지 표시제에 대한 일반음식점의 올바른 인식과 원산지 표시제도의 정착을 통해 소비자들이 믿고 먹을 수 있는 외식 환경이 조성되어야 하며, 국내산 한우와 수입 쇠고기에 대한 소비자 니즈를 충족시키기 위한 노력이 있어야 할 것이다.

FTA 협정관세 심판청구결정의 법적 기준과 검증사례에 관한 연구 (A Study on the Legal Standard and Verification Cases for the Judgement of the Tax Tribunal of FTA Conventional Tariffs)

  • FTA 협정관세는 수입물품이 협정에 따른 협정관세의 적용대상이며, 협정상의 원산지결정기준에 따라 물품의 원산지가 해당 체약상대국일 경우에 적용된다. 협정관세를 적용받고자 하는 수입자는 수입신고 수리 전까지 세관장에게 협정관세의 적용을 신청하여야 한다. 본 연구는 FTA 체약상대국에서 수입한 물품에 대해 FTA 협정관세 혜택이 배제되어 수입자가 관세당국의 결정에 대한 심판청구를 한 사례를 중심으로 검토하여 FTA를 활용하는 기업의 협정관세 적용상 유의점을 살펴보았으며, 이를 바탕으로 다음과 같은 시사점을 제시하고자 한다. 먼저 한 EU FTA와 FTA 관세특례법상의 비당사국을 경유하는 물품의 직접운송원칙과 관련된 유효요건을 확인하고, 한 미 FTA와 FTA 관세특례법상의 원산지증명서의 인정기준과 협정관세 사후적용을 위한 신청기준 등과 같은 협정관세의 적용기준을 확인하여야한다. 그리고 한 EU FTA와 FTA 관세특례법상의 원산지신고서의 발행자 기준과 선하증권의 원산지신고서 인정 여부를 확인하여야 하며, 무역기업은 관세당국의 FTA 협정관세 배제 결정시 조세심판원의 조세심판청구제도를 적극적으로 활용하여 FTA 협정관세 혜택을 향유하여야 한다. 마지막으로 FTA 협정관세 적용과정에서 특정사안에 대해 무역기업과 관세당국 간에 FTA 협정과 관세특례법상 법적용 기준의 해석상 불일치에 대비하여야 한다.

한·중 FTA와 기(旣)체결 주요 FTA의 원산지 규정과 절차 비교연구 - 미국·EU·ASEAN FTA 중심으로 - (A Comparative Study on the Rules of Origin and Origin Implementation Procedure in KORCHINA FTA and Main Korea's Existing FTAs - Focused on KORUS·KOREU·KORASEAN FTA -)

  • The reviewing of an analysis of the Korea-China FTA due to guidance introduced for the new regulations or exceptional regulations compared to the KORUS, Korea-EU, Korea-ASEAN FTA. Commodity sectors in the Korea-China FTA and the KORUS, Korea-EU, Korea-ASEAN FTA(the majority in the country and trade criteria analysis result) compared and analyzed the results, rules of origin and the customs clearance procedures of origin, preferential tariff rate of origin and the origin preferential specific rules are somewhat difference, but customs and trade facilitation regulations are already quite consistent with the Korea customs system. Relatively important research results were as follows. First, the calculation of the regional value content in KORCHINA FTA is that I'm to use the deduction method can comprehensively reflect a regional value ratio, with respect to the materials acquired originating status as the FTA in the US and EU use the product non it's not to consider the value of the originating materials originating materials can be utilized for intermediate goods. Second, even if a non-treaty country in the middle with the exception of direct transport rules, and acknowledge the country of origin are under customs control, there are provisions for the period are temporarily stored in a non-treaty countries separately, that period goods imported into the non-treaty countries and up to three months from the day. Meanwhile, Korea-China FTA has provisions to allow requests for preferential tariff applied on imports Customs declaration of intention to apply pre-condition for a preferential tariff applied to the importer. In other words, if the import customs tariff preference when applying post-intention not to advance is to be noted that any preferential treatment to prevent the later application.

소고기 원산지 표시에 대한 소비자들의 지각도 평가 (The Effect of Declaration of its Country of Origin on Consumers' Attitude to Beef)

  • The aim of this survey is to examine factors that influence on the perceived helpfulness in consumers' predicting its quality and safety when the country of origin (COO) of beef is declared. The data were analyzed that had collected from a consumer survey done in March 2006. 250 consumers living in Suncheon, Jeollanamdo were randomly selected as respondents. Eleven of them did not complete the survey material, so the total number of available samples were 239. All samples were estimated using proc logistic procedure of SAS package. The results indicate as follows: first, the levels of perceived helpfulness of COO in consumers' predicting beef quality and safety depend significantly on he age, the occupation, and the education level of demographic variables. Second, when analysing attitude variables to beef, the levels are significantly correlated with the respondents' ability to acquire information, their trust of information about beef, nd their interest about bovine spongiform encephalopathy(BSE). The proportional odds assumptions of models are not violated at p<0.05. Third, it is the gender, the age, and the education level of the respondents, and the respondents' ability to acquire information which significantly effect on the level of the perceived helpfulness of COO in predicting beef quality. Fourth, it is the consumer's age, their education level, and their trust of information about beef which statistically have a significant effect on the level of perceived helpfulness of COO in predicting beef safety.

ICOH Statement on Protecting the Occupational Safety and Health of Migrant Workers

  • Globally, it is estimated that the number of people living outside of their country of origin reached 281 million in 2020. The primary drive of those migrants when migrating voluntarily is work to increase their income and provide for their families left behind in their home countries. Those who migrate immediately seek means of income to sustain themselves through a perilous process as currently evidenced in the war in Ukraine and not too long ago in Syria and Venezuela. Unfortunately, migrant workers are globally known to predominantly be working in "4-D jobs"- dirty, dangerous, and difficult and discriminatory; the fourth D was recently added to acknowledge the discriminatory aspect and other social determinants of health migrant workers face in their host country while exposed to precarious work. Consequently, migrant workers are at considerable risk of work-related illnesses and injury but their health needs are critically overlooked in research and policy. Recognizing the UN Universal Declaration of Human Rights "Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment", we cannot consider any human life - thus, the life of migrant workers - as dispensable through a structural discriminatory process that undervalues their occupational safety and health, livelihood and the contribution these workers bring to their host countries. This was seen during the preparation for the upcoming world cup in Qatar where migrant workers were exposed to a multiplicity of serious hazards including deadly heat hazards.

  • It has been declared in 1992 at Rio about the management of united water control and method of the management of the water resources at the water basin. And it was also mentioned about the protection of fresh water's quality and it's supply under chapter the 18th of the agenda 21. It has been 10years passed after Rio declaration, and water crisis Is getting more serious than before. Fairly, right for using water resources was given to every life as the public resources. But at the last world water forum, water was commercialized, and regulated as the basic requirement not basic right. Therefore, we could use the water according to the logic of supply and demand at the market, and with money. Furthermore, construction of the big dam which was build to solve the problem of the lack of water became one of problems for water control. Korea is keeping consistent policy such as providing water by the building of dam. Control of the water demand is the most basic and effective policy for the preservation of water resources. If we change the policy such as the construction of the dam, we should put the management of the water demand in the center with the reliable philosophy. United management of the river basin has to be made with the security of water, improvement of water quality, and protection of the ecological side each other. Management of water basin also has to be completed to solve the trouble caused by using water conflict people who live up and down stream. To maintain the good quality of water, management of water basin is necessary. Also, bottom line of the united management of water basin is voluntary involvement of every citizens and local community. We suggest to preserve the origin of river and the upper at the ecological side. It is worth it to preserve.

한국의 인증수출자 제도에 관한 법적 고찰 (Approved Exporter Status in Korea)

  • FTA가 동시다발적으로 체결됨에 따라 특혜 관세의 적용을 위하여 원산지증명서가 중요하게 되었다. 이러한 원산지증명서의 효율적 발급을 위해 원산지 인증수출자 제도가 정착될 필요가 있다. 또한 동 제도가 시행되어 이미 정착되었어야 함에도 불구하고 한-EU FTA 발효 이후에 이슈화되고 있는 점을 감안할 때 시기적으로도 매우 늦은 감이 있다. 따라서 본 연구에서는 원산지 인증수출자 제도를 고찰하고, 동 제도의 조기 정착을 위한 실용화 방안을 제시하여, FTA의 효과를 극대화시키는데 그 목적이 있다. 원산지 인증수출자 지정 및 운영과 관련하여 실용화 방안을 제시하면 다음과 같다. 먼저, 원산지 인증수출자 제도에 대한 실질적 홍보를 강화하여 인증수출자 지정 업체수를 늘려야 할 것이다. 둘째, 산업별 맞춤 원산지관리시스템 구축을 지원하여 원산지 인증수출자의 기본적인 인증요건을 손쉽게 갖출 수 있도록 하여야 한다. 셋째, 원산지관리전담자 양성 기회를 확대하여 해당 인력을 원산지관리전문가로 양성하여야 한다. 넷째, FTA-PASS 서비스 장애 제거를 위한 조기경보시스템을 도입하여 안정적인 시스템을 제공하여야 한다. 다섯째 사후관리 철저 및 위반에 대한 법규를 강화하여 원산지 인증수출자 제도가 안정적으로 정착되도록 하여야 한다.

  • Park Myoung Jin (1903-1957) was a respectable leader who disseminated dental medical education to make our path as the leading dental medical education developing a new global history of dental medicine. Dr. Park was born in Seoul on 3 July 1903. He graduated Kyongseong dental medical school and studied at the pharmacology department achieving his M.D. In 1938, as the president representing the Hanseong dentists association equivalent to the Japanese dentists association, Dr. Park participated in various events. After liberation, Dr. Park tried his best to achieve Korean dental medical education as the pursuit of ideal ego with self-centered ego. He reorganized the Kyongseong dental medical school and incorporated it to the Seoul National University dental college. Even during the Korea war, Dr. Park still sincerely carried out his duties as the director of the Seoul National University dental medical college by recruiting university entrants and turned out graduates. In 1954, Dr. Park as the director of the Seoul National University dental medical college, he frontiered an opportunity to adapt the American dental medicine by sending school staffs to study overseas. On 25 June 1954, Dr. Park received 25 years of meritorius service award presented by Seoul National University Dental Medical College. Further, on 6 Aril 1954, Dr. Park became a member of an academic research committee. In April 1946, Dr. Park was elected as the president of the Chosun Dentists Association(Korean Dental Association). On 19 May 1947, Dr. Park was also appointed as the director of the Korea dental medicine association leading the general meetings and academic conferences from 2nd through the 8th sessions. On 30 November 1954, as the president of the Korea dental medicine association, Dr. Park also published the Korea dental association publications. In 1957, Dr. Park donated the school housing for the principle of the Kyongseong dental medical school establishing the basis for the Korea dentists association center. Dr. Park also participated in establishment of the oral hygiene campaigne, dental administration policy, organization of the specialized subject delegation board members and the dental materials association. On 10 December 1955, we can recognize Dr. Park's respective historical consciousness through his declaration 'history is a true record of historical traces of a national'. Dr. Park was a living witness of the Korean dental industry. Especially, he stated that the origin of the Korean dentists association was in the Hanseong dentists association. Dr. Park overcame the pressure and indignity during the Japanese colonization. The joy of liberation did not last long since he also had to experience the fraticidal tragedy of the Korea war. Dr. Park was a professional dental specialist and a leader researching dental medicine. He was a great leader who understood the dental medicine and dedicated for the dentist association and dental medicine association with compassion for the nation and national as a Korean.

1980년대 민중미술론의 기원과 형성 (The Origin and Formation of Korean Public Art Theories in the 1980s)

  • The theories of Korean Public Art originated by the artists who were against dictatorship and they associated with democratic politicians. They criticized the Fine art that were supported by the dictatorship and gave their efforts for restoration of 'resistance paintings(against dictatorship)', 'proletarian painting', 'realism painting'. In addition, they participated new social ideology(democracy) movement and demonstrated for their rights in arts. These became the main kernel the public art theory was initiated. The public artists splitted into several different parts and participated in the democratic social movement as well as the art movement for freedom. They opened various art exhibitions within different genre, diverse space for various art section such as an exhibition hall, a factories, a university, or a congregation square. Furthermore, the public art theorists published their divergent views through newspaper/broadcasting or unauthorized printed materials. Most of the public artist and the theorists kept their relationship strongly until 1985, the time when 'National Arts Association' started. In 1983 and 1984, they were clearly separated into two parts; artists(move only in art museums) and activists(move in public spaces like school, convention square etc). Their ideological separation also took out national problems. The division; professional artists and armatures, became the social issue as a social stratification matter. And in creating method, there are also other conflicts; critical realism, and public realism as well as western painting and traditional one. These kinds of separation and conflicts made different Public artists associations, under divergent names; 'Reality and Speak'(R&S), 'KwangJu Art Association', 'Durung', 'Dang(Land)', and 'Local Youth Students Association'. In addition, their ideology and pursuit toward art movements were very difference. However, the differences and conflicts weakened When the oppression of democratic education from new dictatorship(Pres. Jun, Doo Hwan) came out. In August. 1985 the government opened to the public so called, 'The draft of School stabilization law'(Hankwon Anjung Bup) to control the teachers' rights and that initiated bigger street demonstration and conflicts between police and educators. In November.1985, assembly meeting of National Arts Association in democracy opened as 'ONE' combined organization. In this presentation, I'd like to summarize the stream of art movement until 1984, and clarify the main art theories that lead the Public Art Movements in 1980s. The main theories in 1980s are crucial because they become the origin of public art theories. This presentation started with O,youn's "Hyunsil Dong In the first declaration" and explained the absent of practice in 1970s. In addition, Won, Dong Suk 's theory was mentioned as all over struggles in theories before 1980s. GA and R&S 's founding declarations in 1970s were the start of public art theorists' activities and this article reported the activities after the declarations. First, realism base on the consciousness of reality. Second, practice art democratization based on the ideology. Third, the subject of public art movement based on understanding people's social stratification structure. Fourth, the matters of national forms and creative ways in arts based on showing reality. Fifth, the strong points in arts that the practitioners accepted. About the public art theories around 1984, I discussed the dividing point of public art theories that were shown in 'generation theory', 'organization theory', and 'popularization theory' by the practitioners. The public realism theory that subjects the contradiction of reality and point out the limits of critical realism not only showing the new creative ways but also giving the feeling of solidarity to the public art activist groups. After that, public art movements expressed 'Dismentlement of Capitalism' and 'Public revolution'. In addition, the direction of public art movements were established strongly. There were various opinions and views during the start and formation of the public art theories. The foundation of theorists activities derived from the practitioners who had the concept based on stratification and nationalism. The strong trend of group division spreaded out by practitioners who opened art work together in factories, universities, squares and rural areas. Now many lively active practitioners are gone to the other field not related with arts, and others join into professional art field not public art one with unknown reason. The theorists have the same situation with the practitioners. It means to me that theory always have to be based on the practice.
